Overtime is checked against the right rulebook
STrOp never decides what counts as overtime for you. The foreman records each line as regular, overtime or double time, and that is what goes on the certified payroll. What was missing was a second look: does what got recorded actually fit the rules?
Approving a timecard now checks the typing against the authority on the contract.
- California — regular time past 8 hours in a day, anything past 12 not marked double time, and the seventh consecutive day of the workweek (overtime from the first hour, double time past 8).
- Federal (Davis-Bacon) — regular time past 40 hours in the workweek, counting the worker's earlier submitted and approved days on the same project.
- Both on a mixed-funded job. Each rule speaks for itself, so the stricter one is always heard.
A few notes:
- It warns, it doesn't block. The approval goes through and the warning names the worker, the rule and the hours that look wrong. Fix the timecard and the certified payroll comes out right.
- Nothing is reclassified. STrOp reports what looks mis-typed. It never moves an hour.
- Private jobs see nothing, same as the wage-floor check.
